This Privacy Policy (the "Privacy Policy") applies to the website and application located at https://pixsee.io/ operated by Pixsee, Inc. ("Pixsee," "us," "our," or "we") and its associated websites, subdomains, mobile versions, any associated mobile applications and services where this Privacy Policy is posted (collectively, the "Sites"), and describes how Pixsee collects, uses, discloses, and secures the personal information you provide through the Sites. It also explains what your rights are, which may differ depending on where you are located. We encourage you to read this Privacy Policy carefully to understand our personal information practices. When you access and use our Sites, you acknowledge that you have read this Privacy Policy, understand it, and that you do not object to our processing activities.

What Do We Mean by "Personal Information" and "Personal Data"?

"Personal information" or "personal data" is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. Personal information that is aggregated (e.g., compiled to create statistics that cannot identify a particular individual) or de-identified (all identifiers obscured such that it cannot be linked to a particular individual) is not considered "personal information" for the purposes of this Privacy Policy.

The Personal Information We Collect and How We Collect It

We collect the following personal information from you:

Information That You Provide Us About Yourself

  • Identifiers: When you complete a form on the Sites or create an account, we may ask you for information such as: (i) contact information, including your name, email address, mailing address, phone number, and Zip code; and (ii) unique identifiers, such as username, account name, or password. This information allows us to provide you with an account, operate our Sites, and send you communications.
  • We also collect identifiers, such as your name, email address, mailing address, phone number, and Zip code, when you communicate with us through email, social media, or paid media campaigns. This information is collected for marketing or promotional purposes. You may unsubscribe from these communications by following the instructions contained within the communication or emailing us at: support@pixsee.io. Please note that due to marketing production schedules you may receive messages already in production.
  • Blockchain and Show Identifiers: Each show on the Sites is assigned a blockchain identifier. When you connect a blockchain wallet, including a Privy wallet, we collect your wallet address. We may correlate show blockchain IDs with your wallet activity to understand what content your wallet interacts with, including spending, viewing, and creation activity.
  • Payment and Transaction Data: When you make a purchase or other transaction on the Sites, we collect payment and transaction information, including records processed by third-party payment processors and on-chain transaction data associated with your wallet.
  • Uploaded Content: We collect content you upload to the Sites, such as media files, text, or other materials you submit.
  • Viewing and Purchase History: We collect information about the content you view and the purchases you make on the Sites.
  • AI Inputs: When you interact with AI-powered features on the Sites, we collect the inputs, prompts, and other information you provide to those features.

Information Collected Automatically

Internet or other electronic network activity information: When you use the Sites we may use cookies and similar technologies ("cookies") to collect information about your location, your activities on our Sites, your interaction with our advertisements and our emails, information about your device, and log information. These cookies may collect Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages (the pages you come from and go after leaving the Sites), the files viewed through our Sites (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data.

Pixels: We may use third-party pixels, including social media pixels. These pixels collect information about your usage of our Sites and transmit this information to third parties, such as social media companies. These social media companies may combine personal information collected via their pixels that may be deployed on the Sites with your social media account and use it for their own advertising or profiling purposes. These pixels allow us to send you personalized advertisements. If you would like to adjust how ads are shown to you on social media, you can adjust your social media account settings.

Google Analytics: We use Google Analytics, a service provided by Google, Inc. ("Google") to help us understand how users interact with the Sites and to enhance your experience when you use the Sites. For more information on Google's privacy practices, please go to policies.google.com/technologies/partner-sites and to opt out of data recording and analysis by Google Analytics on the Sites, please visit tools.google.com/dlpage/gaoptout.

Note that the opt-out is specific to Google Analytics activities and does not affect the activities of other analytics providers that we may use.

How long these cookies stay on your device depends on what they do. For example, some cookies only work while you are visiting the Sites and get deleted when you are done (session). Others may stay on your device unless you choose to delete them (persistent). Cookies may be placed by us (first party) or by other businesses (third party) when you visit the Sites or other online properties.

We may use the following types of cookies:

  • Strictly necessary. These are cookies that are required for the operation of the Sites. They include, for example, cookies that enable you to log into secure areas of the Sites or areas requiring your acknowledgment or consent to proceed.
  • Analytical/performance. These cookies from third-party services allow us to recognize and count the number of visitors and to see how visitors interact with the Sites and our advertising and marketing (including email). This helps us to improve the way our Sites work, for example, by ensuring that users are finding what they are looking for more easily. It also helps us understand the effectiveness of, and improve, our advertising, marketing and content.
  • Functionality. These are used to recognize you when you return to the Sites. This enables us to personalize our content and recommendations for you, greet you by name or remember your preferences (for example, your choice of language or region).
  • Advertising/Targeting. These cookies record your interactions with the Sites, including the pages you visit and the links you click, and our advertising and marketing. We use this information to make the Sites and our advertising and marketing more relevant to your interests. We may also share this information with third parties for this purpose.

Advertising Opt-Out: In the US, you may opt-out of companies participating in the Digital Advertising Alliance ("DAA") program by opting out at optout.aboutads.info, youronlinechoices.eu, and youradchoices.ca/en/tools. For information and to download DAA's AppChoices tool, see youradchoices.com/appchoices. Note that opting out does not mean you will no longer receive online advertising. It does mean that the company or companies from which you opted out will no longer deliver ads tailored to your preferences and usage patterns.

Browser Settings: You may be able to block cookies by activating the setting on your browser that allows you to refuse the setting of all or some cookies. Check your browser's HELP menu to learn the correct way to change or update your cookies. Please see your mobile phone's manual for information on how to do this on your phone's browser. Please note that if you use your browser settings to block all cookies (including strictly necessary cookies) you may not be able to access all or parts of our Sites.

Browser "Do Not Track" and Opt-Out Signals

Some browsers offer a "do not track" ("DNT") option. Because no common industry or legal standard for DNT has been adopted by industry groups, technology companies, or regulators, we do not respond to DNT signals. We will make efforts to continue to monitor developments around DNT browser technology and the implementation of a standard. We honor opt-out preference signals, such as the Global Privacy Control ("GPC"), as another way to opt out of the "sale" of your personal information or its "sharing" for targeted advertising purposes. More information on the GPC is available here.

"Sale" and "Sharing" of Personal Information

We do not sell your personal information for monetary compensation, but we may use advertising and analytics cookies, which may be considered a "sale" or "sharing" of personal information as those terms are defined under applicable privacy laws, such as the California Consumer Privacy Act. At any time, you can opt out of the "sale" or "sharing" of your personal information by emailing us at: support@pixsee.io.

How We Use Your Personal Information

  • To offer our Sites to you: We use your information to provide the Sites to you; to communicate with you, including to send you advertising and marketing communications; to analyze your interactions with the Sites and with our advertising and marketing providers; to identify you; to provide you with technical support and assistance; to provide blockchain-based features and to process transactions; and to promote the Sites to you, including announcements about new offerings.
  • To optimize or improve the Sites: We use your information to understand your usage of our Sites, improve the content on our Sites, measure your satisfaction with our Sites, and improve the user experience generally.
  • To disclose your information to third parties to the extent permitted by law.

How We Disclose Your Personal Information

We may disclose your personal information: (i) to certain third-party service providers, (ii) as required by law, and (iii) in connection with the protection and enforcement of our legal and contractual rights.

  • With Service Providers: We may disclose your information to third parties who provide services on our behalf to help us with our business activities. This may include: website hosting, providing customer service, analyzing interactions with the Sites and sending and analyzing our marketing communications, setting cookies for marketing and analytics purposes, conducting research and analysis, processing payments and transactions, providing blockchain and wallet infrastructure, and providing cloud computing infrastructure.
  • With Public Authorities or Law Enforcement, or in Connection with a Transaction: In certain situations, we may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. We may also disclose your personal information as required by law (such as to comply with a subpoena or other legal process), when we believe in good faith that disclosure is necessary to protect our rights, when we believe there is a violation to any of our terms or other agreement with us, to protect your safety or the safety of others and minors, to investigate fraud, and to respond to a government request. If we are involved in a merger, acquisition, or sale of all or a portion of our assets or if we are involved in a bankruptcy or liquidation proceeding, your personal information may be one of the assets transferred.
  • Prevent Fraud and Abuse of the Sites: We may disclose information to prevent or detect fraud or to address technical issues and if we believe it is necessary to investigate, prevent, or take action regarding situations that involve abuse of the Sites or their infrastructure. The legal basis for this is our legitimate interest in maintaining the security of our Sites.
  • We may process and disclose information in an aggregated, de-identified manner, where the information is shared as part of a statistical report and does not contain personal information.
  • With your consent.

Links to Third-Party Websites

Our Sites may contain links to other websites owned and operated by third parties. After you leave our Sites, we have no control over the information collected from or about you on those third-party websites. These third parties may collect information from you when you interact directly with them. We are not responsible, and assume no liability, for the privacy policies and/or practices of any third party. The use of your information by third parties is subject to their privacy policies and terms of use. Accordingly, we encourage you to visit their sites and review their policies prior to providing any personal information to them.

Chat Feature

Our Sites may have third-party chat feature for support purposes. These features may collect the content of your communications and other personal information you provide while interacting with the chat feature. Please discontinue use of the Sites if you do not consent to the collection of such information by us and third parties.

Disclaimer Regarding Video Content

Our Sites may contain video content, audiovisual content, or content of a like nature (collectively, "Video Content"). In connection with our provision of Video Content, our Sites may utilize online tracking technologies and code-based tools, including, but not limited to, Software Development Kits ("SDKs"), pixels, and advertising and analytics cookies (collectively, "cookies") that track information about your activity and webpage-viewing history on the website. Cookies on or used by the Sites may result in information about your activity on our Sites being transmitted from your browser to us and third parties, which, in turn, may result in the display of targeted advertisements on third-party websites, platforms, and services, including advertisements for our content. In addition, whether cookies on the Sites result in your browser's transmission of information to third parties depends on a number of factors that may be outside of our knowledge or control, including what third-party services you use, what personal information you have provided to such third parties, and whether (and the extent to which) you have limited the use of cookies by the operators of those third-party websites, platforms, and services.

Blockchain and Distributed Ledger Technology

Certain features of our Sites and services may interact with public blockchain networks or distributed ledger technology ("DLT"). This section describes how your personal information is handled in connection with those interactions.

On-Chain vs. Off-Chain Data

We design our Sites and services so that personal information is stored off-chain; that is, on our own servers and systems rather than on any public blockchain. Blockchain transactions associated with your use of our Sites and services are structured to avoid recording personal information directly on a public ledger.

Immutability of Public Blockchains

Public blockchains are, by their nature, immutable and append-only ledgers. Once data is recorded on-chain, it generally cannot be altered, modified, or deleted by us or any single party. As a result, if any information is written to a public blockchain in connection with your use of our Sites, we may be unable to fulfill requests to rectify or erase that information to the extent it resides on-chain, notwithstanding any rights you may have under applicable data protection laws (such as the right to deletion or the right to be forgotten). We will take commercially reasonable steps to minimize the personal information, if any, that is recorded on a public ledger.

Account-to-Wallet Linkage

When you connect a blockchain wallet to your account, we may associate your wallet address and on-chain transaction activity with the personal information in your account. Each show on the Sites is assigned a unique blockchain identifier, and we may correlate show blockchain IDs with your wallet address and on-chain transaction activity to analyze content interaction patterns, including what content is viewed, purchased, or created through a given wallet. We use this association to provide, maintain, and improve our services, to comply with legal obligations, and for the other purposes described in this Privacy Policy. Even where on-chain transaction data is publicly visible, we treat any correlation of that data with your account as personal information subject to this Privacy Policy.

Third-Party Blockchain Infrastructure

Our Sites may rely on third-party blockchain networks, nodes, validators, smart contracts, or other decentralized infrastructure that we do not own or control. These third parties operate independently and have their own data practices. We are not responsible for the privacy or security practices of any third-party blockchain infrastructure, and we encourage you to review any applicable terms or disclosures provided by those operators. Your interactions with on-chain protocols or decentralized applications accessed through our Sites may be governed by separate terms and privacy notices.

Data Security

The security of your personal information is important to us. We implement reasonable technical and organizational security measures to protect the personal information submitted to us, both during transmission and once it is received. We take steps to ensure that such data remains private and confidential. We restrict access to personal information to Pixsee employees, contractors, and agents who need to know that information in order to operate, develop, or improve our Sites. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

Please understand, however, that no data transmissions over the Internet are guaranteed to be 100% secure due to the inherent risks of data transmission over the Internet. Consequently, we cannot ensure or warrant the security of any information you transmit to us, and you understand that any information that you transfer to us is done at your own risk. If we learn of a security system breach, we may attempt to notify you, including electronically, so that you can take appropriate protective steps. By using the Sites or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Sites. We may post a notice via our Sites if a security breach occurs. We may also send an email to you in these circumstances, at the email address you have provided to us. If you have any questions about the security of your personal information, you can contact us via the contact information below.

Data Retention

We may retain your information for as long as needed to provide you with the Sites, comply with our legal obligations, resolve disputes, and enforce our agreements. In certain circumstances, we may be required by law to retain your personal information, or may need to retain your personal information in order to continue providing access to the Sites.

Even if you delete an account you have with us, keep in mind that the deletion by our third-party providers may not be immediate, and that the deleted information may persist in backup copies for a reasonable period of time.

Children's Personal Information

The Sites are not directed to children under 13 years of age, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without verification of parental consent, we will take commercially reasonable steps to delete that information promptly. If you believe we might have any information from or about a child under 13, please contact us using the contact information provided in this Privacy Policy. In accordance with the Children's Online Privacy Protection Act ("COPPA") (15 U.S.C. §§ 6501–6506) and the FTC's implementing regulations (16 C.F.R. Part 312), we will not knowingly collect, use, or disclose personal information from children under 13 without obtaining verifiable parental consent as required by law.

The Sites may be accessed by minors who are at least 13 years of age but under 18 years of age. Where applicable under state law, we will not sell or share the personal information of a user we know to be under 18 years of age unless we have received affirmative authorization ("opt-in") for such sale or sharing. We may otherwise process personal information of known minors only with appropriate consent and in accordance with applicable federal and state requirements, including any requirements for verifiable parental or guardian consent. We encourage parents and guardians to monitor and guide their children's and teenagers' online activity and to contact us with any questions or concerns about our practices relating to minors.

SMS Messaging

In some circumstances, we might require you to opt-in to receive text messages from us. At any time, you may opt-out of receiving particular text messages from us by texting STOP in response to any text message.

For purposes of a text/SMS messaging program, no mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of personal information shared with third parties or affiliates exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties or affiliates.

Submit a Consumer Privacy Request. To exercise any of the above rights, please submit a verifiable consumer privacy request to Pixsee by email: support@pixsee.io

Verification. We cannot respond to your request to know, access, question the result of profiling, limit the use of, correct, or delete your personal information or provide you with a copy of your personal information unless we can verify your identity and your authority to make the request and confirm that the personal information relates to you. A verifiable consumer privacy request must:

  • provide sufficient information that allows us to reasonably verify you are the person, or an authorized representative of the person, about whom we have collected personal information; and
  • describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Authorized Agent. You may, under certain circumstances, authorize another individual or a business, called an Authorized Agent, to make a verifiable consumer privacy request on your behalf. If you wish to have an Authorized Agent make a verifiable consumer privacy request on your behalf, they will need to provide us with sufficient written proof that you have designated them as your Authorized Agent, and we will still require you to provide sufficient information to allow us to reasonably verify that you are the person about whom we collected personal information.

Pixsee's Response. We endeavor to respond to a verifiable consumer privacy request with the time period prescribed by law. If we cannot comply with part or all of your request, we will explain the reasons in our response.

We do not charge a fee to process or respond to your verifiable consumer privacy request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Appeals. You also have the right to appeal a denial of your request by contacting us as described in our notice of denial.

Opting Out of Marketing Emails and Newsletters

At any time, you can add or remove your name from a Pixsee marketing list by contacting us at support@pixsee.io. We will endeavor to comply with your request as soon as reasonably practicable.

Privacy Rights for the European Economic Area, the United Kingdom, and Switzerland

We may process personal data as that term is defined in the European Union's General Data Protection Regulation ("GDPR") and the equivalent UK law. If you are located in the EEA, U.K., or Switzerland, you have the following rights:

  • You have the right to access information about the categories of personal data we have collected about you. You may also request a copy of the personal data we have collected, and upon request, we will provide this data to you in electronic form or transfer it to a third party.
  • You have the right to correct your personal data if inaccurate.
  • You have the right to request erasure of your personal data when such data is no longer necessary for the purposes for which it was collected, when you withdraw consent and no other legal basis for processing exists, or when you believe that your fundamental rights to data privacy and protection outweigh our legitimate interest in continuing the processing.
  • You have the right to restrict our processing of personal data if there is a dispute about the accuracy of the data; if the processing is unlawful; if the processing is no longer necessary for the purposes for which it was collected but is needed by you for the establishment, exercise or defense of legal claims; or if your request to object to processing is pending evaluation.
  • You have the right to object to processing of your personal data based on our legitimate interests or for direct marketing (including profiling). We will no longer process the data unless there are compelling legitimate grounds for our processing that override your interests, rights, and freedoms, or for the purpose of asserting, exercising, or defending legal claims.
  • You have the right to obtain information about, and a copy of, the safeguards we use to transfer personal data across borders.

In processing personal data, we may rely upon the following lawful bases:

  • Consent. We may process personal data with the consent of the individual whose data is being processed, who must affirm that they have obtained appropriate consent from all participants. This includes when we offer our Sites to you which you have requested, and when we administer a contest or other promotion, survey, or feature of our Sites that you have elected to take part in.
  • Contract. When we enter a contract with you for your account, we process personal data on the basis of our contract in order to prepare and enter into the contract, as well as to perform and manage our contract. This is necessary for us to provide the Sites to you.
  • Vital interests. In a case where the personal data is required to protect your vital interests or the vital interests of another natural person, then this may be used as the lawful basis of the processing. For example, we may need to process personal data in the event of a pandemic.
  • As required by law. We may process personal data as required to comply with legal obligations to which we are subject for the purpose of compliance with EEA, UK, or Swiss public, governmental, judicial, or other regulatory authorities. This could include where we are legally required to disclose your information to third parties.
  • For legitimate business purposes. This includes, but is not limited to, legal compliance and the purposes described above. This may also include where we use your personal data to understand your usage of our Sites, improve the content of our Sites, and improve the user experience generally.

Users who are located in the European Economic Area ("EEA"), the European Union, the U.K., or Switzerland have the right to lodge a complaint about our data collection and processing actions with the relevant supervisory authority in their country of residence. Contact details for data protection authorities are available here:

We may need to update this policy from time to time, and we reserve the right to do so as we deem necessary or desirable. We will notify you of such changes by revising the "Last updated" date provided herein, and/or by any other legal means, and your use of the Sites after any such changes shall constitute your consent to such changes.
